Ballot Questions 6 and 7, passed by voters in 2024, will be on the 2026 general election ballot.
NO on QUESTION 6
A ‘No’ vote on Question 6 would keep the Nevada Constitution in its current form and would not impact the availability of abortion as a statutory right under Nevada law.
Existing law states that abortions are legal in Nevada and must occur within 24 weeks after the start of the pregnancy. An exception currently exists to allow an abortion after 24 weeks if a physician reasonably believes that an abortion is necessary to preserve the pregnant person’s life or health. Existing law also requires that abortions performed after the 24th week of pregnancy be performed in a hospital licensed by the State of Nevada. Question 6 language is intentionally misleading.
WHAT IS QUESTION 6?
Question 6 is a proposed amendment to the Nevada Constitution that would establish an unlimited right to abortion throughout all nine months of pregnancy – even when the heartbeat of the preborn child is detected, when the preborn child can experience pain, and when the child is capable of living outside the womb.
What Question 6 Does
PUTS WOMEN AT RISK
QUESTION 6 would jeopardize existing laws and prohibit new ones that voters on both sides of the abortion issue support, including health and safety laws that protect women.
ELIMINATES PARENTAL INVOLVEMENT
“Individuals” includes underage girls and permanently removes parental involvement before an abortion is performed on a child.
ELIMINATES SAFETY AND SANITARY REGULATIONS
Women and children will be at risk when state and local jurisdiction’s zoning laws and health regulations are deemed interference.
ELIMINATES LICENSED PHYSICIAN REQUIREMENT
Current Nevada law requires a licensed physician perform all abortions. While the ballot question says “healthcare professional” the amendment language uses “healthcare practitioner” a term in Nevada law that includes nurses, psychologists, medical laboratory technicians, and other non-doctors who would be allowed to perform abortions.
ALLOWS THIRD TRIMESTER ABORTIONS
Abortion at any point during the pregnancy – even moments before birth – is protected AND unregulated. “Fetal viability” to be defined by Abortionist. No doctor required. No hospital required.
Actual Question 6 Language
‘Should the Nevada Constitution be amended to create an individual’s fundamental right to an abortion, without interference by state or local governments, whenever the abortion is performed by a qualified healthcare professional until fetal viability or when necessary to protect the health or life of the pregnant individual at any point during the pregnancy?’
If voters pass Question 6 in November, the Nevada Constitution will be amended to allow an unlimited right to abortion by any health care professional, at any location, without parental consent for minors up until the time of birth. To change the amendment in the future will require a two-thirds vote of the Nevada electorate.
YES on QUESTION 7
A “Yes” vote would amend Article 2 of the Nevada Constitution to require in-person Nevada voters present certain identification and mail ballot voters to provide certain information in order to cast a legal ballot.
What is Question 7?
It creates a constitutional requirement for voters to provide identification before they receive a ballot.
Voting in-person at a polling place requires a current ID or that has not been expired for more than four years. (If a voter is over 70 years old, the ID could be expired for any length of time so long as it is otherwise valid.)
The acceptable forms of identification include:
Nevada driver's license.
Identification card issued by the State of Nevada, any other State, or the US
Government.
Employee photo identification card issued by the US government, Nevada government, or any county, municipality, board, authority, or other Nevada government entity.
US passport.
US military identification card.
Student photo identification card issued by a Nevada public college, university, or
technical school.
Tribal photo identification.
Nevada concealed firearms permit.
Other form of government-issued photo identification that the Legislature may approve.
Voting by mail ballot would require identity verification by election officials. Information includes:
The last four digits of their Nevada driver's license number.
The last four digits of their Social Security number (if no Nevada driver’s license).
The number provided by the county clerk when the voter registered to vote, if the voter has neither a Nevada driver's license nor a Social Security number.
Actual Question 7 Language
Should the Nevada Constitution be amended to require voters to either present photo identification to verify their identity when voting in-person or to provide certain personal information to verify their identity when voting by mail ballot?
